Klub Kitanda — Terms & Conditions

Last updated: 27 July 2026 · Version 1.0 (draft)

> Status: solid draft, not a lawyer's review. These terms are written to describe how Klub

> Kitanda actually works, and to be readable by the people who use it. They have not been

> reviewed by an advocate. Get that done before the app is submitted to the app stores.

1. What Klub Kitanda is — and what it is not

Klub Kitanda is a discovery service. We find events happening in Nairobi, check them, and

list the good ones. That's it.

We list, we don't sell.

We do not sell tickets. We do not take your money. We do not handle door entry, guest lists,

refunds, or anything else about the night itself. When you tap Book, we hand you off — to

the organiser's ticketing page, to the organiser's WhatsApp, or to their RSVP page. From that

moment the arrangement is between you and the organiser, and we are not a party to it.

Read that once more if you skim nothing else: your ticket is the organiser's contract with you,

not ours.

By using the app or the event pages on our website, you agree to these terms. If you don't agree

with them, don't use it — no account to close, nothing to cancel.

2. What we promise about accuracy — and what we don't

Curation accuracy is the entire product, so we take this seriously and we won't over-promise.

What we actually do:

flyer, or their message to us. Date and start time must match the source or the event is not

published. Ticket links must open and resolve to a ticketing platform we recognise. Prices are

checked against the flyer. Venues are confirmed on a map.

through everything happening soonest first. That's a real ritual with a written runbook, not a

slogan.

pull it first and ask afterwards.**

get close, rather than sitting there looking fresh.

What we cannot promise:

Event details change without warning, and often the organiser is the last to tell anyone. We

cannot guarantee that an event will happen, will happen at the listed time, will still cost what

it cost yesterday, will admit you, or will be any good. **Before you travel — especially for a

late one, and especially if you're paying at the door — confirm with the organiser.** The Book

and WhatsApp buttons exist partly for exactly that.

Tell us when we're wrong. Every event page has a "report a problem" action, and it reaches a

human. A user telling us a listing is wrong is the single most valuable message we get.

3. Cancelled, postponed, rescheduled and sold-out events

not delete it — a listing that vanishes leaves someone still travelling to it.

it changed.

little preview image for a long time and we cannot change it after the fact. **Open the link,

don't trust the preview.**

We rely on organisers to tell us, on our weekly review to catch it, and on users to report it.

None of those three is perfect. We are not liable for your costs if you travel to an event that

was cancelled without us being told.

4. Age-restricted events

Some listings carry an age restriction — typically 18+. That marker is **information copied

from the organiser's own flyer or message**. It is not a promise about who will be admitted.

The venue and the organiser enforce entry, not us. They may check ID, may set a stricter

policy on the night, and may refuse entry for reasons that have nothing to do with age. Meeting

the age shown in the app gets you nothing at the door by itself. Carry ID.

Some listings are adults-only — the organiser's age restriction or "Heads up" note in the app

is the one that counts at the door.

5. Tickets, money, entry and refunds

Everything on this list is the organiser's, not ours:

We receive no share of ticket money and hold none of it. If a ticket link takes you to a third

party (Mookh, TicketSasa, HustleSasa, LipaTix, TurnApp or similar), that company's terms and

privacy policy apply to what happens there — not ours.

Free listings are free for organisers today. We do not currently take payment for placement.

If that ever changes, any paid placement will be labelled as such in the app, visibly, every

time — because an unmarked paid slot would destroy the only thing we're actually selling.

6. Limitation of liability

To the fullest extent Kenyan law allows:

current, or that the event will take place as described.

you found through us — including a cancelled or moved event, a refused entry, a bad ticket, a

fraudulent organiser, a wrong price, or anything that happens at a venue.

liability for fraud, for our own gross negligence, or under Kenya's Consumer Protection Act

where it applies.

This is not us washing our hands: it's the accurate description of a service that lists things

other people run. The commitment we do make is section 2 — we check, we re-check, and we pull

what's wrong.

7. Posters, images and copyright

Event posters are the property of whoever made them. We use them because a poster is how Nairobi

sells an event.

grant us permission to use it to list and promote that event (see our

Listing Policy).

published publicly, we credit the organiser, and we link out to them. Where we are unsure of

the rights, we publish the listing with our own placeholder artwork instead.

organiser's artwork.

Takedown. If you own an image or other material we've published and you want it removed,

email hello@klubkitanda.app with:

  1. the event page link or the event name and date;
  2. which image or text is yours;
  3. a statement that you own it or act for the owner;
  4. how to reach you.

We remove first and discuss afterwards — usually within one working day, and always within

three. If we remove the artwork the listing itself may stay with placeholder artwork, unless the

listing itself is the problem.

The Klub Kitanda name, wordmark and app design are ours. Don't reuse them.

8. Acceptable use

Don't:

links as much as you like — that's the point of them);

found here;

If you do, we'll remove your listings and stop replying to you. There is no account to ban —

blocking the channel is the sanction.

9. How listings get added and removed

Added: either we find the event publicly announced and list it (with credit and a link back),

or the organiser sends it to us. Either way it goes through the same checks in section 2 before

it appears. We list selectively — being turned down is not an accusation, it's an editorial

decision.

Removed: a listing comes down when it's cancelled, when it fails re-checking, when a valid

takedown lands, when the organiser asks us to remove it, or when we decide it no longer belongs

in the app.

**Changes and cancellations from organisers are accepted only through the channel the event came

in on.** If you submitted an event by WhatsApp, we act on WhatsApp messages from that number and

nothing else. That rule is what stops someone "cancelling" a rival's event, and we do not make

exceptions to it over email.

If you're an organiser and want your event delisted, message us on your original channel and

it comes down. We won't argue.

10. Changes to the service and these terms

The app is early and will change. We may add, change or withdraw features, and we may update

these terms. Material changes get a new version and date at the top of this page. Continuing to

use the app after that means you accept the update.

11. Governing law

These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction.

«TODO: confirm the operating legal entity's name and registration number, and put it here plus

in section 1 of the Privacy Policy. Until a company is registered this trades as

the founder personally, with the liability that implies — which is the actual argument for

registering the business earlier than the monetization plan requires.»

12. Contact

Klub Kitanda lists events. We do not sell tickets and we are not the organiser — booking, entry and refunds are between you and whoever sold you the ticket.

Poster artwork belongs to the organiser and is shown with credit. If you hold the rights and want it removed, email hello@klubkitanda.co.ke and it comes down.
